Victorian deadlines for submitting pool safety compliance certificates have been extended. Due to ongoing lockdowns across Victoria preventing many pool and spa owners from booking their pool safety inspections and lodging their pool compliance certificates, the Victorian Building Authority has decided to extend the deadlines for pools and spas constructed before the 1st of November 2020.

FOR POOLS AND SPAS CONSTRUCTED BEFORE 1 NOVEMBER 2021

The new revised deadlines for having your swimming pool barrier inspected and issued with a pool safety compliance certificate are outlined below.

FOR POOLS AND SPAS CONSTRUCTED AFTER 1 NOVEMBER 2021

Deadlines for pools built after the 1st of November in 2020 remain unchanged. You are required to lodge your first certificate of barrier compliance within 30 days of the date of issue of the certificate from your pool inspector. Please note that this certificate must also be submitted along with your application for registration.

After the first submission of the barrier compliance certificate, you’ll be required to submit another certificate every 4 years. At Pool Safety Check, we’ll remind you 3 months prior when it’s time for you to get your next inspection and certificate of compliance.

FEES FOR NON COMPLIANT POOLS

Height Requirement for Pool Fences in Victoria

There have been some changes around the new rules and regulations implemented on the 1st of December 2019 to improve swimming pool and spa safety in Victoria. We'll go through some of the key things to note when it comes to your pool fencing height and if it's within the Australian Standards (AS).

The new laws apply to swimming pools and spas that are capable of holding more than 300 mm (30 cm) of water. This includes permanent pools, above ground pools, indoor pools, hot tubs, bathing or wading pools and some relocatable pools.

AS 1926.1 - 1986

The fences and pool gates shall have an effective height perpendicular height of at least 1200mm (1.2meters) at any point along their length, along the outside of the fencing.

AS 1926.1 - 1993

The effective fencing height shall be not less than 1.2 meters.
The height is considered effective if a quadrant of radius 1.2 m, located as shown, provides a clear span of 1.2 m to finished ground level, or to any projections from, or objects on, the ground, except for non-climbable objects which are able to be positioned within the 1.2 m radius.

AS 1926.1 - 2007

From this standard, it starts to have different requirements to internal and external barriers. Let’s start on the internal; the effective barrier height shall be not less than 1200mm and shall include a continuous non-climbable zone.

The non-climbable zone (NCZ) may be located anywhere on the vertical face of the barrier. In this zone the distance between any hand and foot hold shall be not less than 900mm, this varies from the previous standards.

AS 1926.1 - 2012

Thinking of buying a home with a pool or spa, then the following information is for you. Once you become the proud owner of your home with a pool or spa the following information will be applicable to you.

New Regulations For Pools and Spas in Victoria

The new pool and spa registration and inspection requirements are now in force by the Victorian state government, this is applicable to new and existing (old) pools and spas.

On 1 December 2019, new laws to improve spa and swimming pool safety came into effect. They introduce new registration, inspection and certification requirements for property owners.

Swimming pool and spa owners now have a legal obligation to ensure that the spa or pool barrier or fence system is compliant with the relevant Australian Standard. The owner is responsible for continuing to maintain the effective operation of swimming pool and spa safety barriers.

For Prospective Pool or Spa Owners:

If you are going to buy a house with a swimming pool or spa you will face the following procedures that need to be completed, failure to do so will lead to hefty fines.

As a pool or spa owner you need to complete the following:

Register your pool with your local council by 1 November 2020
Organise an inspection of your pool barrier by a registered swimming pool inspector
Rectify any issues identified by your pool inspection
Submit a certificate of compliance to your council by the due date

Buyer Beware!

At Inspect East Building Inspections , we inspect a lot of homes being sold with pools or spas, and regularly hear bold comments from the home owner and real estate like:

“The pool is compliant as it is registered!”

When we ask the owner to produce the compliance certificate we are confronted by defensive behaviour. The vendor and real estate agent are often not aware that we are also Registered Pool inspectors and we are well aware of the compliance and obligations of pool owners.

The registration of the pool is only the first step (Item 1 of the above list) . The cost to bring a pool up to a standard where a compliance certificate can be produced is often a costly and time consuming exercise. In my opinion, many vendors are motivated to sell their properties simply because they want to pass on their issues and cost implications to an often ill informed purchaser.

These are key warning signs of Buyer Beware Market!! Make sure you get a pre-purchase pool/spa barrier compliance inspection before you commit to purchase your property.

The cost involved in rectifying a barrier system can often be quite expensive and difficult to fix. Some of the items that need to be addressed can be:

House doors and windows leading to pool or spa enclosures,
Climbable objects adjacent to the barrier system (quite often on the neighbouring properties),
Gates that need replacement, and
Barriers of fences that need to be replaced.

The Effect of COVID Lockdowns On Exercising & Swimming

The spike in the number of drowning related deaths of 20% in the last 12 months has the Royal Life Saving Australia concerned. 294 deaths last financial year which is a stark increase.

COVID Lockdowns mean many people are turning to the oceans and rivers to get their daily dose of exercise.

Stay at home restrictions have meant we are keen to get out and explore closer to home and often seek out secluded locations. Even when we are holidaying we are often going to locations that we are unfamiliar with closer to home. This impacts the difficulty of getting emergency services to these locations. Rivers and creek drowning are up 50% this year.

The advice from water safety experts is to check with locals before going swimming. Strong currents are a main concern in rivers and you can’t always see the depth are major drowning risks in inland waterways.

The Royal Life Saving National Drowning report showed young children under 5 are another huge concern considering 25 children have died this year, a 108% increase from the previous year and a 9% increase on the 10-year average. Although young children are always a concern particularly when it comes to drowning deaths, the group aged 25-34 years recorded 17% of all drowning deaths, the highest amongst all age groups.

The contributing factors are parents working from home and home-schooling. The home environment is incredibly risky for young children. In many cases the increase in home drowning are caused by a lapse in adult supervision and parents multitasking.

It only takes a few cm for a young child to die.

Going into summer, young children's confidence in the water is surely going to take a dive as swimming lessons and water confidence awareness classes have been cancelled during COVID lockdowns.

Children missing out on water safety lessons will have an impact on pre-school children and ultimately teenage years unless parents are vigilant in re-enrolling kids as soon as restrictions ease.

Although this restricts the use of public swimming pools, more opportunities to use the pool in your backyard as stay at home restrictions continue.

Does Your Pool Barrier Meet Australian Standards?

Ok, you have questions about the rules and regulations that have been implemented on the 1st of December 2019, to improve swimming pool and spa safety in Victoria.

I have given this some thought and have decided to break the overview down and concentrate on different areas and items that have to be reviewed in the inspection process. Hopefully, the blogs shed some light and help with understanding of the rules or regulations and can assist you with making your pool barrier compliant and safer.

Climb Zone or Non-Climb Zone

What is a Non-Climb Zone? It is an area adjacent to a pool fence or barrier that need to be maintained free of climbable objects to allow the pool barrier (fence) to be effective in preventing children under the age of five from gaining access to the pool area and avoid a potential pool drowning.

Defined in the standards: A non-climbable zone (NCZ) is a zone on a barrier and in the space adjacent to a barrier, running the full length of a barrier including a pool gate, that is intended to restrict climbing of the barrier by young children.

Clear Span

I am going to start with Australian Standards: AS 1926.1-1986 and AS 1926.1-1993 combined as they are both very similar in design.

The 1986 and 1993 standard refer to a 1200mm arch as a clear span that is to be obtained to the outside or approach side of the barrier system.

Internal and Boundary Barriers

FREQUENTLY ASKED POOL SAFETY & COMPLIANCE QUESTIONS

The Victorian Government has introduced new requirements to improve swimming pool and spa safety, including inspection, maintenance and compliance requirements for property owners. It is now mandatory for owners of land where a swimming pool or spa is located to register their pool or spa with the relevant council. If you own a pool or spa in Victoria you must register it with the Council within the municipality, you now need to:

Register the swimming pool or spa with the local council before 1 November 2020.
Arrange for an inspection of your pool or spa safety barrier for compliance every four years.
Lodge a Pool and Spa Barrier Compliance Certificate with the local council every four years.
Pay the prescribed fees to the council upon registration and lodgement of the certificate.

There will be a penalty if landowners do not register the pool or spa by 1 November 2020.

When are barriers required?

All swimming pools and spas capable of containing water greater than 300mm (30cm) must have a compliant safety barrier to restrict access to the pool area by young children (under the age of five). Barriers are required for:

in-ground pools and spas
above-ground pools and spas, including relocatable and inflatable pools that are capable of holding more than 300mm (30cm) of water and require assembly on site.
indoor pools and spas
bathing and wading pools capable of containing more than 300mm (30cm) of water.

When are barriers not required?

inflatable swimming pools (typically toddler or wading pools) that cannot contain a water depth greater than 300mm (30cm).
small inflatable pools that do not consist of multiple components and do not require any assembly. An example of such a product is a small inflatable pool that requires no assembly other than inflation.
bird baths / fishponds / reflection ponds
fountains
water supply/storage tanks/dams
baths used for personal hygiene and emptied after each use
spas inside a building (e.g. in a bathroom) used for personal hygiene and emptied after each use
pools or spas that cannot contain a water depth of more than 300mm.

The objective of this Standard is to assist pool owners/users in avoiding pool related drowning by providing design, construction and performance of various barrier options, which are designed to restrict entry to the swimming pool area by young children.

Statistical evidence shows that the majority of drowning deaths in private swimming pools involve children under five years of age. For this reason, the requirements established by this Standard are directed at achieving a barrier that will make it difficult for a young child to gain access to a pool area, whether under, over or through the barrier. It should be noted that the provisions of this Standard relate to barriers that are intended to be child resistant but not childproof, as effectiveness of the barrier is very much dependent on its location, installation and maintenance. The requirements are established with the intention of leaving a high degree of flexibility to the consumer in the choice of barrier, desirable aesthetics and cost.

It’s amazing when we turn up to properties to conduct a pool barrier inspection, we see gate’s propped in the open position almost on a daily basis.

When it comes to discussing safety concerns with pool safety fence or barrier, we commonly jump straight to discussing the gate’s, door’s and or access points. The reason is that they are the most venerable component of the barrier system as they have moving part/s and require ongoing maintenance and repair to ensure the operation of the gate or door unit is as per the intended use. To remain closed and secure to prevent entry by a young child,

“ALL GATES MUST NOT BE ABLE TO BE OPENED BY YOUNG CHILDREN AND IF OPEN, DOORS AND GATES MUST RETURN TO THE CLOSED POSITION WHEN RELEASED AND REMAIN SECURE”.

This is considered a very important issue, as a large number of the pool drowning cases in Australia occur because the gate or door access point does not have suitable protection and/or has been left PROPPED open.

Its because of this issue that some of the rules and regulations are implemented. Here is some important information to remember when you are considering propping the gate open with that rock or paver.

Building Regulations

Swimming pool and spa barrier gate must remain closed.

An occupier of the land on which a swimming pool or spa is located must take all reasonable steps to ensure that any gate or door forming part of a barrier restricting access to the swimming pool or spa remains closed except when a person is entering or leaving the part of the land on which the swimming pool or spa is located. Penalty: 50 penalty units
A person who opens a gate or door forming part of a barrier restricting access to the swimming pool or spa must ensure that the gate or door is closed immediately after entering or leaving the part of the land on which the swimming pool or spa is located. Penalty: 50 penalty units.

These small steps can potentially save lives.

How to Prepare for a Pool Safety Compliance Check

Make sure your pool and spa are registered with your local council. The new laws apply to swimming pools and spas that are capable of holding more than 300mm water. This includes permanent pools, above ground pools indoor pools, hot tubs, bathing and wading pools and some relocatable pools.

Upon contacting Pool Safety Check have the details of the construction date of your pool or spa handy. You should have this information in a letter from the council.

Check Pool Gates

Pool gates should open and close freely without getting caught on anything which could prevent the gate from closing
Gates should self-close and securely latch when released from any open position, including when released from resting on the latch
Gates should open outwards, away from the pool

Check Garden Beds and Ground Levels

Remove climbable trees from the fence
Ensure the barrier height is at least 1200 millimetres above the finished ground level (permanent stable surface).

Climbable Objects

Trim any climbable branches
Shield any lattice or other climbable material within the non-climbable zone with a non-climbable material such as vertical palings and or suitable material
Trim any climbable vegetation away from the barrier
Remove all climbable objects within the non-climbable zone
